General Terms and Conditions Legal Claim Advice
Article 1: Definitions
In this Agreement, the following terms, both in the singular and plural, have the following meanings:
Legal Claim Advice: Legal Claim Advice, the private company with limited liability, registered in the trade register of the Chamber of Commerce under number 76943097.
Partner: Service providers, natural and/or legal persons who have joined Legal Claim Advice, to whom Legal Claim Advice makes an offer to supply goods or services or to accept work.
Applicant(s): Natural and/or legal persons who are interested in a service from one of the Legal Claim Advice Partners and who provide their contact details to Legal Claim Advice, wishing to get in touch with Legal Claim Advice Partners in a specific field, profession, or sector.
Agreement: Any agreement to which these general terms and conditions apply. These terms and conditions, to the exclusion of third-party terms and conditions, apply to all deliveries of goods or services from Legal Claim Advice to Partners, as well as all related Agreements and legal acts.
Services: The services offered by Legal Claim Advice on its website.
Lead: An expression of interest by an Applicant in a particular product or service of a Partner, which may result in an agreement between the Applicant and the Partner. The Applicant understands that Partners will contact them.
Partner page: The (personal) environment of the Partner on the website, accessible only after entering login details.
Personal data: Any information relating to an identified or identifiable natural person.
Website: www.LegalClaimAdvice.com and other sites managed by Legal Claim Advice.
Controller: The natural or legal person, public authority, agency, or other body that determines the purposes and means of processing personal data.
Article 2: Applicability
2.1 These general terms and conditions apply to all offers, quotations, and agreements between Legal Claim Advice and Partners. Legal Claim Advice does not accept general terms and conditions of its Partners unless expressly agreed otherwise in writing.2.2 Deviations from these terms are only allowed if the parties have expressly agreed to them in writing.2.3 Not only Legal Claim Advice but also all persons engaged by Legal Claim Advice in executing any assignment from the Partner can invoke these general terms and conditions.
Article 3: Services
3.1 Legal Claim Advice facilitates the connection between Partners and Applicants via its website. Legal Claim Advice acts as an intermediary, bringing together supply and demand but does not guarantee a specific result or lead quantity for Partners. Legal Claim Advice is not a party to any agreement potentially made between Partners and Applicants and is not liable for what occurs between them.3.2 The number of leads to be delivered is agreed upon in the order confirmation and can be adjusted with the approval of Legal Claim Advice. Leads are delivered through automated processes.3.3 Legal Claim Advice will provide a maximum of four Partners with the leads received from Applicants.3.4 Partners must quickly follow up on leads and make initial contact within one business day.3.5 All personal data must be treated confidentially and in accordance with applicable laws.3.6 Partners must guarantee their professional qualifications and compliance with industry regulations.3.7 Legal Claim Advice will not reactivate leads or provide them to competitors for at least seven days after delivery.3.8 Partners must provide a valid and working email address.3.9 Partners can set a maximum for receiving leads, but this number may be exceeded by up to 10%.3.10 Only leads actually sent by Legal Claim Advice will be charged.3.11 Legal Claim Advice reserves the right to choose which Partners receive leads.3.12 Partners must ensure that the data they provide is accurate and up-to-date and that they are authorized to use Legal Claim Advice services.
Article 4: Complaints
4.1 Partners may claim leads for the following reasons:
- Duplicate leads within 14 days
- Incorrect Applicant contact details
- Applicant outside the Partner’s specified region
- Applications for study projects or market research
4.2 Complaints must be submitted within five working days via email, and Legal Claim Advice will determine the appropriate compensation.
Article 5: The Agreement
5.1 Service providers can apply to become Partners, and Legal Claim Advice reserves the right to refuse applications without providing reasons.5.2 Partners must accept the terms and conditions upon signing the agreement.5.3 Legal Claim Advice makes no guarantees regarding the outcome of the services provided and does not ensure a specific number of leads unless explicitly agreed upon.5.4 Terms for Legal Claim Advice are not strict deadlines unless explicitly stated in the agreement.5.5 Legal Claim Advice is not liable for any damages or costs incurred due to the Partner’s use of the Partner page.5.6 The Partner is responsible for safeguarding login credentials for the Partner page.5.7 The agreement can be terminated by either party via email, subject to agreed notice periods.5.8 Partners must provide all necessary information for the proper execution of the agreement.5.9 Personal data will only be deleted upon explicit written request.5.10 Legal Claim Advice may terminate the agreement immediately if the Partner violates the terms or becomes insolvent.
Article 6: Rates and Payment
6.1 For each lead provided, Legal Claim Advice will have a claim on the Partner, and the rates stated in the agreement will apply.6.2 Payment is not dependent on the outcome of leads.6.3 Legal Claim Advice may adjust rates at any time with prior notice.6.4 Invoices will be sent by email.6.5 Payment must be made within 14 days unless otherwise agreed.6.6 Partners may not offset or transfer rights and obligations without written consent.6.7 Late payments incur interest, and SmartHomeQuotes may transfer claims to third parties.
Article 7: Liability
7.1 Legal Claim Advice is not liable for any damages to Partners.7.2 Legal Claim Advice’s liability for direct damages is limited to the invoice amount for the services provided.
Article 8: Complaints
8.1 Complaints must be submitted in writing within five working days.
Article 9: Intellectual Property Rights
9.1 The content of the Legal Claim Advice website, including texts, images, and methods, is the property of Legal Claim Advice and is protected by copyright.
Article 10: Force Majeure
10.1 Legal Claim Advice is entitled to suspend service delivery during situations of force majeure.
Article 11: Amendments
11.1 Legal Claim Advice may amend these terms and conditions at any time.
Article 12: Applicable Law
12.1 These terms are governed by Dutch law, and disputes will be submitted to the court in Eindhoven.
